TERMS AND CONDITIONS OF CERTIFIEDTRANSLATIONS.BE

1.    IDENTITY OF THE SELLER

The webshop found at www.certifiedtranslations.be(hereinafter ‘the Website’) is the property of and is operated by Veduta BV (hereinafter ‘Certifiedtranslations.be’), having its registered office at 3001 Heverlee, Interleuvenlaan 62, Belgium, with company registration number 685 416 747 and VAT number BE0685416747.

2.    DEFINITIONS

2.1. Customer: Any natural or legal person who uses the services of Certifiedtranslations.be through its Website.

2.2. Services: All services offered by Certifiedtranslations.be through its Website.

2.3.  Remote Agreement: Any contract between a company and a customer concerning goods or services concluded within the framework of a system for the remote sale of goods or services organized by Certifiedtranslations.be, whereby exclusive use is made of one or more means of remote communication up to and including the conclusion of the contract itself;

2.4. Means of remote communication: Any means which, without the simultaneous physical presence of the company and the Customer, can be used for the conclusion of a contract between these parties;

2.5 Terms and Conditions: The general terms and conditions of Certifiedtranslations.be, as set out herein.

3.    SCOPE

3.1. These Terms and Conditions apply to any offer made by Certifiedtranslations.be and to any Remote Agreement concluded between Certifiedtranslations.be and the Customer.

3.2. Prior to the conclusion of the Remote Agreement, these Terms and Conditions will be made available to the Customer electronically. For this purpose and prior to the conclusion of the Remote Agreement, Certifiedtranslations.be will indicate where its Terms and Conditions can be consulted electronically.

3.3.  In addition to these Terms and Conditions, if expressly stated, specific conditions may apply to certain Services. In the event of any differences between the specific conditions and these Terms and Conditions, the provisions of the specific conditions will prevail over the Terms and Conditions, unless stipulated otherwise.

3.4. Deviation from one or more provisions of these Terms and Conditions is only possible if expressly agreed in writing. In that event, the other provisions of these Terms and Conditions shall remain in full force and effect.

3.5. Certifiedtranslations.be reserves the right to amend and/or supplement the Terms and Conditions at any time for future orders.

3.6. By using the Website of Certifiedtranslations.be and/or placing an order, the Customer accepts these Terms and Conditions as well as any other rights and obligations as stated on the Website.

4.    CONCLUSION OF THE AGREEMENT 

4.1. An agreement is concluded when the payment of the Customer has been processed correctly through the online ordering system of Certifiedtranslations.be and when the order has been accepted by Certifiedtranslations.be.

4.2. Quotes provided on the Website, including the stated completion times and prices, are intended solely for information purposes for the Customer. Since they are calculated on the basis of information provided by the Customer and since Certifiedtranslations.be has no control over the correctness and accuracy of the information provided, they are only valid after verification and acceptance by Certifiedtranslations.be, regardless of the fact that the Customer receives an order confirmation after placing the order.

4.3. In the event that the information provided by the Customer during the ordering process is found to be incorrect, incomplete or inaccurate, Certifiedtranslations.be has the right to cancel the order and to adjust the quote on the basis of the corrected information, or to request additional information from the Customer in order to make a correct offer to the Customer, as detailed below.

4.4. The Customer and Certifiedtranslations.be expressly agree that a valid agreement can be concluded by using electronic forms of communication. In particular, the absence of a signature does not affect the binding force of the offer and its acceptance. The electronic files of Certifiedtranslations.be serve as proof, to the extent permitted by law.

5.    ORDER PROCESS

5.1. When the Customer places an order and Certifiedtranslations.be accepts it, Certifiedtranslations.be will fulfil it within the deadline mentioned in the quote.

5.2. The Customer chooses one or more types of documents when placing the order. The Customer agrees that if he chooses the wrong type of document, the offer provided by Certifiedtranslations.be may not be correct and the order may be rejected by Certifiedtranslations.be.

5.3.  The Customer acknowledges that the quote calculation offered on the Website is only a tool to calculate a price indication for Certifiedtranslations.be’s Services. Certifiedtranslations.be makes every effort to provide a quote that is as accurate as possible, but cannot exclude the possibility that it may not be accurate in certain cases. If necessary, after confirmation and payment of the order by the Customer, Certifiedtranslations.be will contact the Customer and provide a new quote. If the Customer accepts the quote, the Customer will be asked to pay the remaining amount of the quote or Certifiedtranslations.be will refund the overpaid amount to the Customer within 5 working days.

5.4. If Certifiedtranslations.be modifies a quote and the Customer does not accept it, Certifiedtranslations.be will repay any advance payment already made within 5 working days. If the Customer specifies an incorrect document type during the ordering process and then makes payment and confirms the automatically generated quote, Certifiedtranslations.be will modify the quote to match the actual document type. If the Customer then decides not to proceed with the order, this situation will be handled as a Cancellation as specified under 5.5.

5.5. If the Customer wishes to cancel the order after confirmation and payment, the Customer can submit a request by contacting Certifiedtranslations.be at info@certifiedtranslations.be. If the order is not yet in progress, it can be cancelled and refunded after deduction of a 30 EUR excl. VAT administration fee. If the translation was already started or finished, the services which have already been carried out will be charged, with a minimum of 50% of the order value. The remaining amount will be credited and refunded.

5.6. The Customer receives a confirmation email after placing an order. The Customer can follow their order at any time via the link mentioned in this email. The confirmation email merely contains an overview of the order placed by the Customer and may not be considered to imply acceptance of the order by Certifiedtranslations.be.

6.    DELIVERY

6.1. The terms stipulated in writing at the time of the order are only valid after the Customer has completed the payment. Any changes to the order after the payment has been made will invalidate the deadline specified. The Customer acknowledges that the deadlines for delivery are indicative and may be extended for reasons beyond the control of Certifiedtranslations.be, including delays at the court or with suppliers. In addition, the stated delivery date only refers to the date on which the translation will be shipped or will be ready for collection by the Customer, and not to the physical delivery of the translation.

6.2. When the order is ready for shipment or collection, a scanned copy of the ordered translation will be sent to the Customer
by email.

6.3. Actual delivery will take place by registered mail or upon collection by the Customer, depending on the option selected by the Customer during the order process.

6.4. Certifiedtranslations.be is not responsible for any delays in delivery by the postal services.

6.5. If the Customer has opted to collect the translation, such collection shall take place within 30 days after the Customer has received notification that the translation is ready. The translation will be destroyed after this period.

7.    PRICES

7.1. All prices are in euro.

7.2. Prices are calculated according to the daily rates on the day the offer is drawn up, unless explicitly stated otherwise.

7.3. We always charge VAT. The VAT charge is always clearly stated in the offer.

7.4. The correctness of the mentioned prices, as mentioned in Articles 4 and 5, will depend on the provision of correct information by the Customer. If this information is found to be incorrect, Certifiedtranslations.be has the right to modify the prices and re-submit them to the Customer for approval.

8.    PAYMENT

8.1. Orders placed through our Website can only be paid for electronically via the Mollie payment service.

8.2. To ensure safe online payment and the security of your personal data, the transaction information will be transmitted securely using SSL technology.

8.3. If the Customer selects a credit card payment, the payment will be subject to the terms and conditions of the relevant card issuer. Certifiedtranslations.be is no party in the relationship between the Customer and the card company.

8.4. In the event of a cancellation or revocation of payment by the card company, Certifiedtranslations.be has the right to dissolve the agreement with immediate effect or to suspend (further) delivery until the Customer has made payment in full.

9.    PRIVACY

10.    RIGHT OF RENUNCIATION

In accordance with the Belgian Law on Market Practices and Consumer Protection, the Customer may not exercise the right of renunciation for contracts relating to the supply of goods manufactured to the consumer's specifications or which are clearly personal in nature or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly. The services offered by Certifiedtranslations.be fall within this definition. Consequently, the Customer does not have the right to revoke an order that has been placed.

11.    COMPLAINTS AND WARRANTY

11.1.  If the Customer is of the opinion that the Services of Certifiedtranslations.be do not meet their expectations, he must report this to Certifiedtranslations.be within 8 days of receipt. After a thorough investigation, Certifiedtranslations.be will propose a solution within 3 working days after the complaint has been submitted. If the investigation shows that an error has been made in the Services, Certifiedtranslations.be will, if necessary, redeliver the Services to the Customer free of charge.

12.    LIABILITY

12.1. The liability of Certifiedtranslations.be is limited to the provision of non-compliant services free of charge. Any consequential damages are explicitly excluded. The Customer expressly acknowledges that the commitment between the Customer and Certifiedtranslations.be involves an obligation of means and not an obligation of result.

12.2.  Certifiedtranslations.be may include on its Website links to other websites that may interest or be informative for the visitor. Any such links are purely informative. Certifiedtranslations.be is not responsible for the content of the website referred to or its use.

13.    FORCE MAJEURE

13.1. In case of force majeure, Certifiedtranslations.be is not obliged to fulfil its obligations towards the Customer. Certifiedtranslations.be will be entitled to suspend its obligations for the duration of the force majeure event.

13.2.  Force majeure means any circumstance beyond its control as a result of which the fulfilment of its obligations towards the other party is wholly or partially prevented. These circumstances include among others strikes, fire, business interruptions, power failures, failures in a (telecommunication) network or connection or used communication systems and/or the unavailability of the Website at any time, non-delivery or late delivery of suppliers or other hired third parties, illness and the absence of any governmental permit.

14.    INTELLECTUAL PROPERTY

14.1. Certifiedtranslations.be is not liable for infringements of reproduction rights of third parties if it carried out the translation order in good faith. Only the Customer will be liable in this case. Any dispute concerning reproduction rights suspends the execution of the order.

14.2. The Customer expressly acknowledges that all intellectual property rights to the information, communications or other expressions displayed in relation to the services and/or the Website are vested in Certifiedtranslations.be, its suppliers or other entitled parties.

Intellectual property rights include, inter alia, patents, copyrights, trademarks, designs and models and/or other (intellectual property) rights, including both patentable and non-patentable technical and/or commercial know-how, methods and concepts.

14.3. The Customer shall not make use of and/or make changes to the intellectual property rights as described in this article, such as, for example, reproduction without the express prior written consent of Certifiedtranslations.be, its suppliers or other entitled parties, unless this is solely for private use of the service itself.

15.    APPLICABLE LAW AND COMPETENT COURT

15.1.  All offers and agreements are exclusively governed by Belgian law.

Any applicability of the Vienna Convention on Contracts for the International Sale of Goods is expressly excluded.

15.2. Any disputes relating to or arising from offers made by Certifiedtranslations.be, or agreements entered into with it, will be submitted to the courts and tribunals of Leuven, unless a mandatory provision of the law expressly designates another court as competent.

16.    FINAL PROVISIONS

16.1.  No failure or omission of either party to enforce or comply with the terms or conditions of this Agreement shall constitute a waiver of such terms or conditions.

16.2.  If any provision of these Terms and Conditions should be unlawful, void or for any other reason unenforceable, it shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions. These Terms and Conditions constitute the entire agreement between the Customer and Certifiedtranslations.be with regard to the subject matter contained herein.
